Property tax assessment indians disagree with tax bill
If your home or property was originally purchased from the federal government prior to January 26, 1847, then your home is permanently exempted from paying property taxes to the State of Indiana. This date would be the first purchase date on your abstract. This title would be a federal land patent dated before January 26, 1847. It does not matter that you were not the original purchaser, of if the land was subdivided or repeatedly sold. The land is exempted from taxation forever. Any tax laws passed by Indiana must comply with the federal ACT of 1847. This is the very ACT upon which the State of Indiana bases it’s authority to pass property tax statutes. However the ACT of 1847 clearly states: “the assent of Congress is hereby given…., to impose a tax or taxes upon all lands hereafter sold by the United States, in said States,” The problem is the clause “hereafter”. Indiana became a State in “1816”, much of the land had been sold by 1847 when the Congress of the United States gave Indiana the right to begin taxing all lands sold hereafter. Remove the property that Indiana has no legal right to tax, and the property tax system is over. It may have been a long time that Indiana has been
violating the law, but the law has never been changed, and Indiana must obey the federal statute. Inform your legislator that Indiana must comply or face a federal law suit.
